Building regs excavated basement did vendor misrepresent?

  • Building regs excavated basement did vendor misrepresent?

    Has anyone come across this problem? We have just bought a property with an excavated basement (mid 1980's). On the property information form the vendor ticked 'no ' to the question 'are there any building control issues to resolve'.

    No paperwork was provided as, although the local authority agreed a building control application had been made, the file had been lost. We have now discovered that the brick walls of the basement finish about a foot above the floor i.e the walls are just sitting on a foot of earth. Whoever did the work just put a thick layer of cement around the outside of the wall to stop the soil falling into the basement! So the whole basement needs underpinning. This could not possibly have satisfied building control regs at that time!

    Do we have any come back against the vendor or is it a ' let the buyer beware' situation'?

    What did your surveyor say about it? You did have your own survey didn't you?
