    Hope someone can respond on this with guidance.

    We are in the process of selling our leasehold flat - all surveys and searchs have been completed however the only sticking point is with our freeholder. Over the last 7 years our freeholder has been very quiet so much so that we paid our ground rent electronically into an account and that was that. Buildings insurance etc were left up to us and the other flat to arrange.

    It transpires that our freeholder died in Dec 2010 and the solicitors were not aware of our property when they finalised the estate. We're now in a situation where the beneficiary (presume new freeholder) lives in the US and we're trying to get responses to our solicitors questions. There doesn't appear to be any legal requirement for them to respond.... What are the options open to us?? I've been told by our solicitors that an indemnity is not appropriate in this situation. Can we exchange contracts at this stage??

    We're looking to complete in 3 weeks time and this is become a pressing issue.
