Lease/freehold confusion

  • Lease/freehold confusion

    We have just got to the point of signing contracts and have noted an issue regarding free/leasehold. The house itself is Freehold but there is some confusion over the land itself being leasehold and we're concerned about signing.

    The particular paragraph which we are finding confusing is as follows:

    "There are two title numbers to the property as initially the property was held under a lease. In 2003 the proprietors of that time purchased the freehold to the property also, so there is no longer a landlord to the property and you are obtaining both interests, The release of this is that the lease to the property, in respect of covenants, is obsolete. Rights granted in the lease however are still valid, and therefore the lease remains relevant for this reason"

    I did mean to add, that we have shared access to the rear of the property with our adjoining neighbours and we are hopeful the lease applies only to this piece of land.
