  • Vacant possession etc

We have just exchanged on a property and are due to move in next Friday. Our buyer is ready to move into our property on Friday too. We were adamant not to exchange while the property was tenanted because as a family with young children we can't face the prospect of the implications of having sitting tenants. Reluctantly the vendor agreed to exchange on vacant possession. The exchange date was yesterday. Tonight I drove past the property and it seems that it is still occupied.

We also have lost all faith in the agent's/vendor's honesty and integrity, so would really like to visit the property and find out from the horses mouth (so to speak) if and when the tenants are leaving. We would of course be polite and non-aggressive. But is this viewed as harassment? I know it might be frowned on if we were the landlord, but we're not...

Don't exchange until the tenants have actually gone! Perfectly reasonable to to go and ask them when they are going. They might say they weren't going!

As a conveyancing solicitor I want to be helpful (England/Wales only) but can't accept liability for this.
