Can a developer go against planning permission after completion?

    I would appreciate some advice on this situation.


    A development which has an underground car park passes planning permission with the provision that each flat in the mixed use building is allocated a parking space.


    This is clearly stated in the plans which state that there must be 22 spaces, one for each of the 22 residential flats and this is also shown on the plans marked with numbers marked 1-22.



    Could the developer/management company retain any deeds once completed and sell the flats without parking, going against the planning permission?


    Any advice or thoughts would be greatly appreciated.


    ps I am not a developer wanting to do this!

      I would say not, the planning officers put those sort of things in to ensure new properties dont cause road or parking congestion in the area.

        In the end, what is to stop one flat owner selling their parking space?
        Basically the planning condition is the provision of 22 parking spaces, this has not changed.

          It depends on whether the title states there is a car parking space provided
          upon purchase. If yes then the only way is for the flat owner to sell separately. If it wasnt in the contracts or title deeds then the developer still owns them.
