Council charge for access across amenity land

    I am in the process of buying a house which has a parking space at the end of the garden that may be accessed across council owned amenity land, essentially a 5" strip of "grass verge" between the property and the road. The previous owners had a licence in place to allow access across the land at a charge of £50 annually. The council is willing to re-grant this licence, with the same fee

    My query, is this legal or justified to enforce a monetary charge. Has anyone had a similar experience?
